This policy addresses how schools, teaching staff and TAFEWA colleges and staff discharge their duty of care to students. ’Duty of Care’ is a legal concept that has its origins in common law. Enrolment policy - under the School Education Act 1999 children are entitled to be enrolled at a public school provided they meet general residential qualifications. Three objectives apply in determining eligibility for a particular school: maximising local access, offering a choice of schools, and ensuring an appropriate educational program. An underlying principle of the policy is that students cannot be enrolled in more than one school. To cater for students attending programs outside of the enrolling school, procedures have been developed for alternative attendance arrangements. A table has been included to assist principals’ awareness of the conditions applying to enrolment of visa holders. 23.04.09 - Version 1.1 published which contains amended forms in appendices F1 and G.

A principal will allow each parent access to a student and his or her information, unless there is a court order to the contrary. The principal, in allowing such access, will have due regard to the student’s safety and welfare, educational needs, and the proper management of the school. This policy replaces the Family Law Issues in Schools policy.
